Secretary of State for the Colonies was unable to recommend the said Ordinance for Her Majesty's approval. And His Excellency The Governor having been advised of those exceptions in a Despatch from the Colonial Office which also required that steps should be taken to remedy the defects complained of, the above Ordinance was prepared and adopted by the Legislative Council.

Exception was taken to sections X and XI of Ordinance No 8 of 1860 on the ground that the language in which they were expressed was vague and open to the construction that the Legislature of Hong Kong had thereby attempted to make law for foreign and other countries.
